Tiger Woods seeks to block subpoena for drug records in DUI case

Tiger Woods’ attorney Douglas Duncan is trying to block a prosecutor’s subpoena to see the 50-year-old’s prescription drug records, according to court documents obtained by CBS News. Prosecutors requested records such as prescription type, number of pills, dosage, medication instructions, next refill date and warnings, including vehicle operation, at Lewis Pharmacy in Palm Beach, Fla., from Jan. 1 to March 27.

“When the state makes a connection between the records and a criminal investigation to justify its intrusion into Mr. Woods’ privacy, it is clear that this right to privacy is not absolute,” Duncan wrote in the motion.

Woods is Involved in a two-vehicle collision on March 27th His SUV clipped the back of a trailer and overturned near his home on Jupiter Island, Florida. The 15-time major champion was charged with misdemeanor drunk driving with criminal damage to property and refusing to submit to a legal test.

“The defense opposes the issuance of the subpoena and asks the court to hold a hearing to determine whether the prescription records are ‘relevant to a criminal investigation,'” Duncan continued.

If the subpoena is granted, Duncan asked the court to issue a non-disclosure order governing the use and release of the records. Upon request, only the state, its law enforcement officers, state experts, and defense officials would be able to review them in secret.

“The records may not be disclosed to any third party, including any order prohibiting the state from distributing the records in response to a public records request,” Duncan wrote. “If the State is required to publicly disclose such records, or any portion thereof, a public hearing shall be held to determine the need for such disclosure.”
